Terms of Service
All amounts are in Japanese yen (JPY), tax included.
Article 1 (Application)
- These Terms set out the conditions between Headliner LLC (Headliner 合同会社; "we" or "us") and customers ("you" or "Users") for using HachiProxy, our purchasing proxy service (the "Service").
- By using the Service, you are deemed to have agreed to these Terms.
- The separate rules and policies we publish for the Service (Legal Notice, Pricing, Refund & Cancellation Policy, Prohibited Items, and our Privacy Policy) form part of these Terms.
Article 2 (Definitions)
- Proxy purchase: our purchase of an item at a store in Japan (Mercari, Amazon.co.jp, trading card shops, etc.; each a "Supplier") at your request.
- Quote: the item price, service fee, domestic shipping & handling fee, and card hold amount that we calculate and present based on the product URL or other information you provide.
- Card hold: an authorization placed on your credit card or other payment method for 110% of the total at the time of your order.
- Purchase confirmation: our actual purchase of the item from the Supplier and our charge (capture) of the actual amount.
- Pickup location: our location in Shibuya, Tokyo, where we hand items over to you in person.
Article 3 (The Service)
- The Service is a service in which we purchase items on your behalf at your request and hand them to you in person at the Pickup location when you visit Japan.
- We do not ship internationally. Items can only be received in person at the Pickup location.
- We may change the Suppliers and items covered by the Service without prior notice.
Article 4 (Registration and Identity Verification)
- To use the Service, you must register in the manner we specify (including email verification).
- You must keep your registration information accurate and up to date.
- We verify your identity when you pick up your items. Please bring a government-issued photo ID (such as your passport). If we cannot confirm that the name on your order, the name on your pickup reservation, and the name on your ID all match, we may refuse to hand over the items.
Article 5 (Quotes, Orders, and Card Holds)
- When you submit a product URL or similar, we retrieve the page once and present a quote. If we cannot read the page, we will ask you to enter the price or our staff will review it.
- Quotes have an expiration time and become invalid if you do not order before it expires.
- When you order, we place a hold of 110% of the total. This margin covers price changes; when the purchase is confirmed, we charge only the actual amount (see Pricing for details).
Article 6 (Purchase Confirmation, Price Changes, and Unavailable Items)
- A purchase is confirmed when we buy the item from the Supplier and charge (capture) the actual amount.
- We may be unable to confirm a purchase because the item is out of stock, has already sold, its price has changed significantly, or for similar reasons. In that case, we release the card hold and you are not charged.
- Our staff make the final check of stock, condition, and authenticity by eye. If the information we retrieved automatically differs from the actual item, our staff's assessment takes precedence.
Article 7 (Fees and Payment)
- You agree to pay the total of the item price, service fee, and domestic shipping & handling fee, as calculated on the Pricing page.
- Payment is by credit card, Apple Pay, or Google Pay (payment processor: Stripe). We do not store your card number.
- We place a card hold when you order and charge (capture) the actual amount when the purchase is confirmed.
Article 8 (Handover, Pickup, and Storage Period)
- After we purchase and receive your item, we hand it over at the Pickup location by appointment (appointments: weekdays 10:00–18:00 JST).
- Please pick up your items within 45 days of our arrival notice.
- If you do not pick up your items by the deadline, the order is treated as canceled and no refund is given (because we have already purchased and paid for the item). If you have unavoidable circumstances, please contact us.
Article 9 (Cancellations, Returns, and Refunds)
- You may cancel free of charge before the purchase is confirmed (while the card hold is in place).
- After the purchase is confirmed, we cannot accept cancellations, returns, or refunds for your own reasons, because we have already purchased and paid for the item.
- For details, including what happens if an item is defective or significantly different from its description, see the Refund & Cancellation Policy.
Article 10 (Prohibited Items and Prohibited Conduct)
- We do not accept items listed in Prohibited Items.
- You must not:
- use the Service for any purpose that violates the law;
- register false information or impersonate another person;
- infringe our rights or the rights of others, or interfere with the operation of the Service.
- You acknowledge that proxy purchases are made in accordance with each Supplier's terms of sale. We may decline requests that may violate a Supplier's terms (such as purchase quantity limits, bans on buying for resale, or rules on proxy purchases).
Article 11 (Items Including Download Codes)
- For items that come with a download code, online code, or similar, we will print the code sent to our purchasing account on paper and hand it to you together with the item at pickup.
- Codes intended for Japan may not work with accounts registered in other countries or regions. We do not guarantee a code's expiration, usable regions, or terms of use, and we cannot give refunds because a code cannot be used. Please check the code's terms before ordering.
Article 12 (Used Items and Items from Individual Sellers)
- The Service includes used items and items from individual sellers (such as on Mercari). Their condition varies, and we do not authenticate items or guarantee that they work.
- We are not the seller of the items; we act on your behalf to make the purchase. For defects in the item itself or differences from its description, as set out in the Refund & Cancellation Policy, we will negotiate a return or refund with the Supplier or seller and pay you the amount we are able to recover from them. We do not guarantee the outcome of these negotiations.
Article 13 (Disclaimer and Limitation of Liability)
- We are not liable for damage caused by natural disasters, communication or system failures, changes by Suppliers, or other causes not attributable to us.
- If you suffer damage due to a cause attributable to us (for example, we bought a different item from the one you specified, or an item was damaged or lost while in our care), we will compensate you for direct and actual damage up to the amount you paid for that order.
- The limit in the preceding paragraph does not apply in cases of our willful misconduct or gross negligence.
Article 14 (Personal Information)
We handle your personal information in accordance with our separate Privacy Policy. For payment and identity verification, we may provide information to third parties outside Japan, such as Stripe and Google (Firebase).
Article 15 (Changes to These Terms)
We may change these Terms as necessary. Revised Terms take effect when posted on our website. We will notify you of material changes in a reasonable manner.
Article 16 (Governing Law and Jurisdiction)
- These Terms are governed by the laws of Japan.
- The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute between you and us relating to the Service.
